The importance of consulting with other professionals to maintain acceptable standards of care is well documented in many health care professions. However, evidence indicates that many psychologists fail to utilize consultation when needed, and that consultation use varies along dimensions such as the education and training of the consultee, the type of setting, number of years in practice, and proximity to available consultants. In this article, we review the research on the use of consultation by psychologists as well as other (...) health care professionals. We discuss the clinical, ethical, and legal implications of seeking consultation as a professional psychologist. Finally, a detailed and practical model for the regular use of consultation is given to improve the routine use of consultation in clinical practice. (shrink)

I begin by distinguishing four different versions of the argument from evil that start from four different moral premises that in various ways link the existence of God to the absence of suffering. The version of the argument from evil that I defend starts from the premise that if God exists, he would not allow excessive, unnecessary suffering. The argument continues by denying the consequent of this conditional to conclude that God does not exist. I defend the argument against Skeptical (...) Theists who say we are in no position to judge that there is excessive, unnecessary suffering by arguing that this defense has absurd consequences. It allows Young Earthers to construct a parallel argument that concludes that we are in no position to judge that God did not create the earth recently. In the last section I consider whether theists can turn the argument from evil on its head by arguing that God exists. I first criticize Alvin Plantinga’s theory of warrant that one might try to use to argue for God’s existence. I then criticize Richard Swinburne’s Bayesian argument to the same conclusion. I conclude that my version of the argument from evil is a strong argument against the existence of God and that several important responses to it do not defeat it. (shrink)

Theorists analyzing the concepts of race and gender disagree over whether the terms refer to natural kinds, social kinds, or nothing at all. The question arises: what do we mean by the terms? It is usually assumed that ordinary intuitions of native speakers are definitive. However, I argue that contemporary semantic externalism can usefully combine with insights from Foucauldian genealogy to challenge mainstream methods of analysis and lend credibility to social constructionist projects.

Philosophers writing on the subject of human action have found it tempting to introduce their subject by raising Wittgenstein's question, 'What is left over if you subtract the fact that my arm goes up from the fact that I raise my arm?' The presumption is that something of particular interest is involved in an action of raising an arm that is not present in a mere bodily movement, and the philosopher's task is to specify just what this is. Unfortunately, such (...) an approach does not take us very far, since a person could properly be said to raise his (or her) arm while asleep or hypnotized even though he (or she) would not be performing an action in the sense of 'action' with which philosophers are particularly concerned. To avoid this kind of difficulty I shall approach the subject of human action is a more academic way: I shall expound some important rival theories of human action, and introduce the relevant issues by commenting critically on those theories. One of the issues I eventually introduce is a metaphysical one. A theory of action makes sense, I contend, only on the assumption that there are such 'things' as actions (or events). After considering some key arguments bearing on the issue I conclude that, as matters currently stand in philosophy, a metaphysically noncommittal attitude toward actions and events seems justified. In his recent article Perry Hendricks presents what he calls the impairment argument to show that abortion is immoral. To do so, he argues that to give a fetus fetal alcohol syndrome is immoral. Because killing the fetus impairs it more than giving it fetal alcohol syndrome, Hendricks concludes that killing the fetus must also be immoral. Here, I claim that killing a fetus does not impair it in the way that giving it fetal alcohol syndrome does. By examining the (...) reason why giving a fetus this condition is wrong, I conclude that the same reasoning, on common pro‐choice accounts, does not apply to killing the fetus. Accordingly, Hendricks's argument does not succeed in showing abortion is immoral. (shrink)

Can we legitimately speak of ethicsexperts? Recent literature in philosophy and medical ethics addresses this important question but does not offer a satisfactory answer. Part of the problem is the absence of an examination of what it means to be an expert in general. I therefore begin by reviewing my analysis of expertise which appeared earlier in this journal. We speak of two kinds of experts: persons whose expertise is in virtue of what theyknow (epistemic expertise), or what theydo (performative (...) expertise). Applying this analysis to the domain of ethics, I argue that we may speak of ethical expertise in three epistemic senses: a) expertise indescriptive ethics, b) expertise inmetaethics, c) expertise innormative ethics, and in a performative sense: d) expertise inliving a good life. The Darwinian concept of natural selection was conceived within a set of Newtonian background assumptions about systems dynamics. Mendelian genetics at first did not sit well with the gradualist assumptions of the Darwinian theory. Eventually, however, Mendelism and Darwinism were fused by reformulating natural selection in statistical terms. This reflected a shift to a more probabilistic set of background assumptions based upon Boltzmannian systems dynamics. Recent developments in molecular genetics and paleontology have put pressure on Darwinism once again. Current work (...) on self-organizing systems may provide a stimulus not only for increased problem solving within the Darwinian tradition, especially with respect to origins of life, developmental genetics, phylogenetic pattern, and energy-flow ecology, but for deeper understanding of the very phenomenon of natural selection itself. Since self-organizational phenomena depend deeply on stochastic processes, self-organizational systems dynamics advance the probability revolution. In our view, natural selection is an emergent phenomenon of physical and chemical selection. These developments suggest that natural selection may be grounded in physical law more deeply than is allowed by advocates of the autonomy of biology, while still making it possible to deny, with autonomists, that evolutionary explanations can be modeled in terms of a deductive relationship between laws and cases. We explore the relationship between, chance, self-organization, and selection as sources of order in biological systems in order to make these points. (shrink)

Simone de Beauvoir offers one of the most interesting philosophical accounts of childhood, and, as numerous scholars have argued, it is one of the most important contributions that she made to existentialism. Beauvoir stressed the importance of childhood on one's ability to assume one's freedom. This radically changed how freedom was construed for existentialism. Rather than positing an adult subjectivity that tries to flee freedom through bad faith, Beauvoir's account forces a recognition of a situated freedom that itself is also (...) developmentally achieved. In this article, I explore the influence of Jean-Jacques Rousseau on Beauvoir's discussion of childhood. By reading Beauvoir through Rousseau — who was one of her favorite authors — we see not just one but two accounts of childhood in Beauvoir's philosophical work. On the one hand is the idealistic childhood wherein the child is an apprentice to freedom. On the other is the constrained childhood whose product is apprenticed to the serious. I begin with a brief summary of Rousseau's Emile. Next, I offer some justification for reading Beauvoir alongside Rousseau before offering an account of Beauvoir's discussion of childhood. I end by exploring some of the implications of my reading for freedom. (shrink)

At first glance, atheism seems simple to define. If atheism is the negation of theism, and if theism is the view that at least one god exists, then atheism is the negation of this view. However, the common definitions that follow from this insight suffer from two problems: first, they often leave undefined what “god” means, and, second, they understate the scope of the disagreement between theists and atheists, which often has as much to do with the fundamental character of (...) reality as with the existence of one being in it. Some writers address the second problem by reinterpreting atheism as the logical consequence of particular metaphysical views, such as naturalism or physicalism, which are then taken as the true meaning of atheism. These interpretations, though more satisfactory in some respects, can result in concepts of atheism that are unclear or too narrow, and they often still leave “god” undefined. In this paper, I propose that atheism be defined as the proposition that reality is solely an impersonal order. Theism is the proposition that reality is not solely an impersonal order, being either a personal order, that is, an order founded by at least one person, or an impersonal order plus at least one transcendent person. A god is a person who is not subject to the laws governing that order and thus transcends it. I explain these definitions and briefly discuss some of their implications. First I survey prior definitions of atheism to display the problems they raise. (shrink)

In 1973-1974 Stanley N. Cohen of Stanford and Herbert W. Boyer of the University of California, San Francisco, developed a laboratory process for joining and replicating DNA from different species. In 1974 Stanford and UC applied for a patent on the recombinant DNA process; the U.S. Patent Office granted it in 1980. This essay describes how the patenting procedure was shaped by the concurrent recombinant DNA controversy, tension over the commercialization of academic biology, governmental deliberations over the regulation of genetic (...) engineering research, and national expectations for high technology as a boost to the American economy. The essay concludes with a discussion of the patent as a turning point in the commercialization of molecular biology and a harbinger of the social and ethical issues associated with biotechnology today. In light of recent doctrinal changes, we examine the confused state of U.S. insider trading law, identifying gaps that permit certain market participants to trade on the basis of material nonpublic information, and contrast U.S. insider trading doctrine with the European approach. We then explore the ethical implications of the status quo in the U.S., explaining why the dominant legal justifications for prohibiting classical insider trading and misappropriation—the fiduciary duty and property rights theories—fail to account for the wrongfulness of insider (...) trading by eavesdroppers and certain tippees. We refute common arguments for legalizing insider trading, including arguments that insider trading is a victimless crime and that the practice promotes efficiency. We explain why insider trading constitutes the moral wrong of cheating, grounding our theory in the legitimate expectations of market participants. Having considered Kantian deontology in other work, we find that virtue ethics theory offers a helpful albeit rough framework for assessing the morality of insider trading independent of its legality. We also find that social contract theories, with norms of equality of opportunity and moral desert, provide a compelling ethical basis for retaining, clarifying and broadening current legal prohibitions against insider trading. The United States juvenile justice system has primary oversight of youth who come into contact with legal authorities. This system is purposefully distinct from the adult system given the presumption of youths’ reduced culpability for delinquent behavior and increased potential for rehabilitation. Some juvenile court policies and practices are supportive of youth while others may drive youth further into the juvenile justice system. Today, we are at a point in which we can—and should—use information technology to accrue data to unpack (...) the impact of these policies and practices on and across youth. Moreover, technology-driven policies and practices such as electronic monitoring may be detrimental to the well-being of youth, whereas others such as video conferencing could be more widely used to benefit youth. While juvenile courts hold youth accountable for their behavior, courts also need to be accountable to youth by employing data-informed policies and practices that advance the health and well-being of youth. The negative impact of adverse experiences in childhood on neurodevelopment is well documented. Less attention however has been given to the impact of variations in “normative” parenting behaviors. The influence of these parenting behaviors is likely to be marked during periods of rapid brain reorganization, such as late childhood. The aim of the current study was to investigate associations between normative parenting behaviors and the development of structural brain networks across late childhood. Data were collected from a longitudinal sample of (...) 114 mother-child dyads (54% female children,Mage 8.41 years, SD = 0.32 years), recruited from low socioeconomic areas of Melbourne, Australia. At the first assessment parenting behaviors were coded from two lab-based interaction tasks and structural magnetic resonance imaging (MRI) scans of the children were performed. At the second assessment, approximately 18 months later (Mage 9.97 years, SD = 0.37 years) MRI scans were repeated. Cortical thickness (CT) was extracted from T1-weighted images using FreeSurfer. Structural covariance (SC) networks were constructed from partial correlations of CT estimates between brain regions and estimates of network efficiency and modularity were obtained for each time point. The change in these network measures, from Time 1 to Time 2, was also calculated. At Time 2, less positive maternal affective behavior was associated with higher modularity (more segregated networks), while negative maternal affective behavior was not related. No support was found for an association between local or global efficacy and maternal affective behaviors at Time 2. Similarly, no support was demonstrated for associations between maternal affective behaviors and change in network efficiency and modularity, from Time 1 to Time 2. These results indicate that normative variations in parenting may influence the development of structural brain networks in late childhood and extend current knowledge about environmental influences on structural connectivity in a developmental context. The pairing of “whiskey” and “women” may at times be seen as an instance of what I call conspiratorial vices. Conspiratorial vices, I argue, are phenomena that, when working together, inform each other in a way that sets their content. Taken individually, the elements of the conspiracy are, at best, ambiguous with regard to their moral status. The conjoining of the concepts yields the status as “vice” and points to something deemed a threat to the social fabric. Through the use (...) of two cases, I examine possible ways that this instance of conspiratorial vice might be seen as a multifaceted political tool that both contributes to oppression and creates a site for resistance. This paper has arisen from a concern that much recent policy-related research on markets displays misogynistic tendencies. In both the media and academic accounts it would appear as though the blame for social and educational inequalities can now be laid at the door of women - particularly middle-class mothers. Through examining competing perspectives on how we might understand this attribution of blame, this paper argues that their guilt is best explained not through changes in behaviour but through the conjuncture of (...) shifts in education policy and related research. These shifts have turned the attention of research away from the public domain of the state and the organisational and cultural attributes of schools to focus on the private domain of domestic decision-making. But the representations of these public and private domains are underpinned by unexamined gendered and ideological subtexts which have limited our powers of description and explanation. The paper concludes by suggesting strategies through which we might both address the tacit misogyny in research on markets and develop more sophisticated accounts of contemporary changes. (shrink)

This article examines the particular moral obligations of solidarity focusing on the solidary commitment against injustice or oppression. I argue that political solidarity entails three relationships—to other participants in action, to a cause or goal, and to those outside the unity of political solidarity. These relationships inform certain obligations. Activism is one of those obligations and I argue that violent activism is incompatible with the other relations and duties of solidarity. Activists may find themselves confronted with a difficult choice between (...) respecting the relationships of political solidarity or employing physical violence in resistant self-defense against oppressive practices. -/- . In the course of his readings, Krajewski explores the complex relationship between truth-telling and lying, being and non-being, clarity and obscurity, the fixed and the unstable, the extraordinary and the commonplace. Underlying these dichotomies is an even more fundamental opposition between two approaches to language and discourse. One is the way of philosophy and linguistics, where the objective is to reduce language to its purest logical form. The other is the way of hermeneutics and rhetoric, where the aim is to (...) preserve the multifariousness of discourse as it occurs concretely in everyday life. This book is an argument for the importance of diversity in society. It is not naive, in the sense that it does not argue that any diversity is helpful, but rather tries to distinguish some of the ways in which it can be helpful and, hence, some the conditions under which it can be helpful. It does this is a largely non technical language and using informal argument using argument, examples and a review of the evidence to support its conclusions. (...) Many of our inherited civic institutions are dead or dying. We need an ambitious reform program to revive democratic life. This essay advances a four-pronged “citizenship agenda”: a campaign finance initiative granting each voter fifty “patriot dollars” to fund candidates and political parties of his or her choice; a proposal for a new national holiday, Deliberation Day, held before each national election, enabling citizens to deliberate on the merits of rival candidates; a system of federally financed electronic news-vouchers to permit (...) professional journalism to survive the destruction of its traditional business model; and a new form of citizenship inheritance, which provides $80,000 to all Americans as they start off life as adults. Working with collaborators, I have developed each of these initiatives at book length. This essay suggests how the “citizenship agenda” yields a whole that is larger than the sum of its parts.
